Can you patent a name and if so how do you go about finding out if its already been taken ?

A name doesn't represent an inventive step or invention, as such. You can trade mark it, you can protect it with copyright, but not patent it. Well, you could, but to do so would be ineffective and bloody expensive.

trademark is your best bet but it isnt cheap.

If you're going to use it as a trade name look at web domain names as well. finding one that hasn't gone is tricky
